    I'm guessing it goes down 5-4 but who knows I guess.

    Anyone have any bets on what they've decided?

    CNN TV is reporting that the entire ACA is upheld by way of congress tax provisions, not commerce clause.

    LOL, now they are saying partly upheld, partly struck down. This is too funny. I'm thinking they should STFU, read the inch and half thick decision and then report!

    Well the good news for conservatives is that, based on the DREAM Act, we can just refuse to enforce the thing once a Republican becomes President.

    SCOTUSblog gives the impression it's 5-4 in favor of the mandate, with Roberts' being the saving vote. Interesting.

    Yes, limited government died today (as long as they frame every coercion as a tax).

    I hereby propose putting a $500,000 tax on every abortion. Hey, I'm not banning abortions. I'm just using the taxing power. Also, a $10 million tax on gay marriages.

    Love the smell of hyperbole in the morning..

    Haven't been able to get to the decision yet but I would think that the Court would strike down a tax that is clearly structured to be a ban when such a ban would otherwise be unconstitutional. Furthermore the taxing power used in ACA is not being used in that manner so it seems to be a stretch to say that this decision would enable what you describe (again, haven't been able to get to the actual decision, this is obviously speculation)
