Although Alan Greenberg attended Philcops dinner and workshop on Environmental Injustice and declared , at that meeting, that he was going to be the Environmental Justice office of Philadelphia, nothing has come of his declaration.

Now Councilman Jones introduced Resolution 120740 http://legislation.phila.gov/attachments/13573.pdf

First paragraph of that Resolution reads "Supporting the Commonwealth Court decision which found ACT 13 unconstitutional because it removes from local governments the ability to meaningfully legislate in a manner that protects the health, safety & welfare of it's citizens by addressing localized concerns to oil and gas development & violate both the Pennsylvania and U.S. Constitution , creating a zoning scheme that supercedes the protections local officials are sworn to uphold, as well as the health, safety and welfare of it's residents that local officials must protect."

The City of Philadelphia did not apply these sworn duties to the health and welfare and safety of the effects of the Devon Project and has participated in deliberate prejudice and harm for years, causing extreme harm and loss to neighbor by allowing development on a contaminated site and allowing years of reckless and illegal methods. The City of Philadelphia and cronies, especially in the real estate and development community of the NW, have also nurtured a climate of extreme prejudice, hate crimes, assault with varied and many years of haz mat which proves to cause serious illness.

The City of Philadelphia also, like the GAS companies, refused to honor several doctors demands to remove neighbor to safety and instead secretly trucked away contaminated dirt. One the the outrages of the gas industry is their attempt to bar medical doctors from information about what their patients have been exposed to and as well, the gas companies want to ban doctors from telling their patient what they have been exposed to.

This leads to mass manslaughter as these chemicals, wether old toxic dumps or new fracking chemicals or asbestos in brick dust or lead in dirt being stirred up by excavation which the city allows favored developers and cronies to proceed in reckless and dangerous manner without any concern for neighbor's health and welfare. These are crimes.

City and local leadership in the Northwest response to the nearly 7 years of illegal and serious failure of due diligence in East Mt Airy
has consistently refused to protect health and welfare and added to the problem with malicious and deliberate violations of environmental justice principles, hate crimes, assault with haz mat causing serious and long term injury and circumstances that lead to death such as lung disease and cancer. Civil rights violations and environmental felony and dangerous whistleblower retaliation.

The District Attorney Seth Williams has followed Lynn Abrams example of never prosecuting the "crimes' of the politically connected and have continually caused extreme harm to those they are sworn to protect.

Hopefully this somewhat new configuration of City Council and Mayor Nutter new girlfriend Lisa Jackson will demand remedy these crimes and protect the citizens of this city and implement stronger language in the new zoning code regarding the long time and national core principal of Zoning. "Thou shalt not harm thy neighbor."

On April 3, 2006 I went to the Water Department at the Aramark Building and was given an ariel view of the Devon when the coal bins where still along the railroad and cars were strew across the lot. I was also given stream maps showing one of the headwater area of the Wingohocking running through the old Anastasi Masonry site and under the homes on East Sydney. Many people knew about the contamination and the stream and the maps and records were at PWD and L&I basement. Copies can be seen on the website I started to show the problems inherent in building on that site. The collage I made for the title page shows a portion of that ariel map which I received a copy of from PWD.

One of my concerns which I repeatedly expressed to the city and City planning was the wisdom of such a heavy footprint like the Devon townhouse project over so much water and questioned where that water would go when the flood plain was destroyed. A number of tragedies have happened due to the project that should have never been built on contaminated land and on the Wingohocking and under conditions of fraud and failure of environmental due diligence.

I suggest that City Planning simply stop building on the Wingohocking as it has traditional caused so many problems- sinking homes, making people sick from pollutants and deaths.

The chemicals and uncontrolled dust and asbestos from years of bad building practices and an original plan that violated best practice laws, environmental laws and was pushed through simply by the political will of EMAN, 9th Ward Democratic Committee and City Council and politically connected lawyers and developers, in spite of known health hazards.

We all know nobody cares if I die early due to the exposure of haz mat which I'm still struggling with and it is a daily struggle which disables more and more and leads to early death, but now, there is another death from a flood that may very well be related to the Devon project.

Early on, a geo engineer eyeballed the situation and said there was going to be trouble, but I could not afford thousands of dollars to do the work the builders and city were required by due diligence and support of health and welfare and basic good building practices. Whatver they did took zero consideration of nearby neighbors or the future of new residents.

So City Council, ZBA and City Planning: now you have human death on your hands due to your political games. Who knows what future harm you will cause because of the sloppiest , most illegal and inconsiderate project since Thomas Berrian, also the contractor for the Devon project wrecked the E Penn Project as described by Jim Foster. Former Ward leader Vernon Price sat at the ZBA table with Thomas Berrian pitching the project which John Connelly of the 9th ward democratic committee set up for his friend and often business partner Valencia Macon on land he claimed belonged to his friend Stan Smith, a Chestnut Hill alumni. Stan Smith is partners with Ken Weinstein in Philly Retail.

What where they thinking to chose a contractor who wrecked the E Penn Street project 3 years earlier and have him stay on the Devon project for years until it was run into ruin and bankruptcy? Now Vernon Price is staff for his friend the District Attorney Seth Williams who refuses to prosecute the many and varied crimes in these projects.

Death and assault, environmental felony and other crimes have happened. I still don't have a safe place to live and politically approved and directed hate crimes are constantly directed toward me, denial of civil rights and obstruction of justice at the highest levels of Philadelphia politics and NW leadership.

Notice Jim Foster does not mention the human toll of the Devon project when he refers it. He also made a mistake in saying the project was finished because when he wrote this article , they were still trying to repair the damage done earlier and I was forced to evacuate once more due to stripping of outside walls which caused harmful dust particulates to fill my property and lungs. Jim Foster had plenty of time as a journalist to bring out the human health factors of the Devon project as I sent him the copies of violations and doctors notes.

Plus ZBA received the same information plus more about the health and welfare and safety issues.

The abuse of human life by the city and all those involved has been deliberate and now it continues to get worse.

Perhaps this new City Council will clean up some of the corruption and value human life more than the pocketbook interests of political connected developers and lawyers. Zoning corruption is one of the most prevalent areas of corruption in the USA and Philadelphia must hold several trophies in zoning corruption.

I wonder how much illness and death has been caused by these purely selfish interests and I question why the city feels it is so important to harm people rather than just do things correctly in the first place.

Corruption has always depended on secrecy and retaliation. Governments have become little more than racketeering scams barely discernable from mafia organizations. There is little protection for the average citizen from the crimes of Philadelphia government and cronies.

The "Green City" is still short cutting basic common sense safety and eco salvation for interests of their big campaign contributors, mainly developers and their lawyers.

This government is run more like a racketeering gang then a US government sworn to serve the health and welfare of the people.

Wingohocking has never been buried quietly. The Wingohocking is like the angry and revengeful undead . It didn't want to get buried or poisoned and has always wrecked havoc.

Same thing went on with Lynn Abrams , who was also notified about the environmental crimes and hate crimes and civil right violations on the Devon site. Governor Rendell and Le anna Washington also participated in the crimes against the neighbor next to the Devon Site. The "Green Mayor" is well aware of the environmental injustice crimes.

Cindy Bass has refused to Resolve and amend the crimes the city politicians and NW developers and lawyers committed toward the Devon Town house neighbor who is still very ill and target of constant crimes and terrorized by the retaliation by the NW community leaders and City whose only concern is to cover up their crimes.

Although I recognize many failed opportunities in the new zoning code and room for hidden agenda so the City can continue it's Robber Baron tradition of manipulating the public and getting their favors of votes and bribes (no doubt) - from the politically connected developers and shaft the public , they have hit such lows now as to be obviously capable of causing death to citizens to cut back on required public safety and best practices and due diligence and crony up - as usual_ to the developers.

I Highly suggest, people of Germantown who recently lost one of their own in flood death will wake up and stop eating up the lies of the political gang in the NW and City and demand BEST Practices and a real voice in what happens in this city.

The leaders of Philadelphia literally feel they are entitled to cause death and illness of the general population and people cower under their threats and retaliation or fall for their political snake charm.

Health and safety has been core standard of Zoning for decades, yet City Council is still trying to undermine it.

Zoning is one of the biggest corruption crimes in the country. This country is being destroyed by political games. My home, my health, my life, my livelihood and civil rights have been stolen by Philadelphia Corruption.

I STRONGLY SUGGEST THE People of Germantown who suffered the flood tragedy and the family of the young woman who died do everything they can to learn how the city is harming them and take action.

One thing you can do and anybody who has been affected by the corruption of CITY HALL, LAWYERS, Judges and Police or any kind of abuse toward them by the power elite such has connected developer make a video telling what happened to them.

Truth is welcome. The Civil Rights Movement against Corruption and Gov. Conflict of interest is snowballing across the nation.

Many say Philadelphia is Corrupt and Content. NOOO That is a line used by those who don't want you to demand fair and just government.

Councilman Jone's Bill is simple. It is nothing really new. Health and Welfare and safety of neighbors has, for years and nationwide- been a core golden rule of zoning.

This particular Bill was promoted by the public as a response to violations of this basic zoning law by the Gas Fracking industry. http://legislation.phila.gov/attachments/13573.pdf Read the Bill.

A municipality or City Council or ZBA ruling can not take perogative to apply the rules to some projects and some citizens and not others. That is illegal.

The "thou shalt not harm thy neighbor in zoning" has been around a long time - as has the Philadelphia way of twisting that rule to prejudice and harm against some and hold up and protect others.

The City has yet to resolve and amend the violation of the health and welfare and safety standards as it relates to me and the haz mat and other bad practices of the Devon Project which has caused years of health and safety issues and code violations and other extreme nuisances to myself and others. Like flood dangers of the Wingohocking, failed response to emergency haz mat. Failed due diligence and obstruction of justice. Encouragement of prejudice, hate crimes and civil rights violations. Causing and covering up ongoing dangers which make home unsafe and non transparency toward other neighbors as well.

Cover up of environmental felony and fraud. Surrounding my home with years of bad building practices without heeding medical warnings and quality of life consideration. Etc Etc.

In other words, the City Council, ZBA, Planning and developer and community leader interests are well aware of the "Thou Shalt not harm thy Neighbor" standards in zoning yet show prejudice and deliberate denial of these protective laws toward specific people, including myself. That prejudice is illegal and a civil rights violation and in this case, also considered environmental injustice.

The mayor, city council, planning, ZBA, the District Attorney should have no trouble recognizing the crimes and life threatening violations here and should have no problem resolving them.

Unfortunately, the city and those involved have continued to obstruct justice and failed in their sworn duties toward my safety, directly retaliated with hate crimes and daily I live with environmental illness, unable to receive treatment needed and have lost use of home due to ongoing hazards and abuses.

Legal recourse has been obstructed due to politics and retaliation abuses. Therefore I do what I can, which is to expose these crimes by the city and cohorts. Maybe someday they will come to their senses.

In the meantime, my energy is limited and I do what I can which is expose the crimes done toward me and join with others who suffer similar harm done to them by municipalities, lawyers, developers, government agencies.
